These Terms of Use ("Terms") govern your use of the BreathEasy AI mobile application ("BreathEasy," the "App"), provided by Playful Souls LLC ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
BreathEasy provides real-time air quality information, wildfire proximity data, weather alerts, and AI-generated briefings to help you make everyday decisions about outdoor activity. The App is an informational tool only.
BreathEasy does not provide medical, health, or emergency advice. The air quality readings, wildfire information, forecasts, and AI briefings are for general informational purposes and may be delayed, incomplete, or inaccurate. Do not rely on the App for decisions affecting health or safety. Always consult qualified professionals and official emergency services (such as local authorities and 911) in urgent situations, and follow the guidance of your physician regarding any medical condition.
Environmental data is sourced from third parties including the U.S. EPA AirNow program, NASA FIRMS, NOAA / the National Weather Service, and Open-Meteo. We do not control and are not responsible for the accuracy, availability, or timeliness of third-party data. AI briefings are generated automatically and may contain errors.
You agree not to misuse the App, including by attempting to reverse engineer, interfere with, overload, or gain unauthorized access to the App or its systems, or by using the App in violation of any applicable law.
The App and its content (excluding third-party data) are owned by Playful Souls LLC and protected by applicable laws. These Terms do not grant you any right to our trademarks or branding.
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or accurate.
To the maximum extent permitted by law, Playful Souls LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of or reliance on the App or its data. Our total liability shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.
We may modify the App or these Terms at any time. Continued use after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles.
